1. Acceptance of Terms
By creating an account, posting a job, accepting work, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old, legally able to enter contracts, and (for taskers) authorized to work in the United States. RushTasker currently operates only within the State of Florida.
3. The Platform's Role
RushTasker is a technology marketplace that connects independent service professionals ("Taskers") with people seeking local help ("Customers"). RushTasker is not a party to the service agreement between a Customer and a Tasker, does not employ Taskers, and does not perform tasks itself. Taskers are independent contractors.
4. Accounts and Verification
You must provide accurate, current information and keep it up to date. Taskers must complete identity verification (KYC) before accepting paid work. You are responsible for activity on your account and for safeguarding your password.
5. Bookings, Pricing & Payments
Customers and Taskers agree on price and scope through the Platform. RushTasker may collect payment on behalf of Taskers, hold funds in escrow, and release them upon job completion. Service fees, processing fees, and applicable Florida sales tax may be added at checkout and disclosed before purchase.
6. Cancellations & Refunds
Cancellations and refund eligibility are governed by our Refunds & Cancellations Policy, incorporated by reference.
7. User Conduct
You agree not to misuse the Platform. Prohibited conduct is described in our Acceptable Use Policy.
8. Reviews and Content
You retain ownership of content you post (reviews, photos, messages) and grant RushTasker a worldwide, royalty-free, sublicensable license to host, display, and distribute it for operating and promoting the Platform. Reviews must be honest, lawful, and based on a real transaction.
9. Disputes Between Users
Customers and Taskers should first try to resolve disputes directly. RushTasker may, at its discretion, mediate, withhold escrowed funds pending resolution, or remove users who violate these Terms.
10. Disclaimers
The Platform is provided "as is" and "as available." RushTasker disclaims all warranties to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific outcome of a Tasker's work. See our Disclaimer for more.
11. Limitation of Liability
To the maximum extent permitted by law, RushTasker's total liability for any claim arising out of or relating to the Platform is limited to the greater of (a) the fees you paid to RushTasker in the 6 months before the claim, or (b) US $100. RushTasker is not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless RushTasker, its officers, employees, and agents from any claim or demand, including reasonable attorneys' fees, arising from your use of the Platform, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your account at any time for violations of these Terms, suspected fraud, or to protect the safety of our community. You may close your account at any time from your dashboard.
14. Governing Law & Arbitration
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute will be resolved by binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association, except that either party may bring an action in small-claims court. You waive the right to a jury trial and to participate in a class action.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced on the Platform or by email. Continued use after the effective date constitutes acceptance.
